Cancellation and Refund Policy

Preamble & Purpose

THIS CANCELLATION AND REFUND POLICY (“Policy”) is issued by CGS AI Tech LLP, a Limited Liability Partnership duly incorporated under the Limited Liability Partnership Act, 2008, bearing LLPIN ACY-3562, operating under the brand name “Court-Kachahri” (hereinafter referred to as the “Company,” “we,” “our,” or “us”), accessible at www.court-kachahri.com and associated mobile applications (collectively, the “Platform”).

This Policy forms an integral part of the Terms and Conditions of Court-Kachahri and governs all fee payments, subscriptions, professional consultation charges, non-litigation service payments, cancellations, and refund requests across the Platform. By engaging in any financial transaction on the Platform, Users unconditionally agree to be bound by the terms of this Policy.

1. Fee Structure and Payment Categories

Court-Kachahri facilitates multiple categories of legal, compliance, and educational services, each governed by specific fee structures as outlined below:

2. Revenue Sharing Framework (70:30 Model)

2.1 Transparent Marketplace Split

For every paid consultation, non-litigation service, assignment, or engagement obtained through Court-Kachahri, the Company maintains a strict and transparent revenue-sharing model:

  • Seventy Percent (70%) of Service Value: Payable directly to the Independent Professional (Advocate, Law Firm, Chartered Accountant, Company Secretary, or Compliance Consultant) rendering the actual service.
  • Thirty Percent (30%) of Service Value: Retained by CGS AI Tech LLP as the Court-Kachahri Platform Coordination Fee.

2.2 Scope of Platform Fee

The 30% Platform Fee supports technology infrastructure, AI tool development, professional credential verification, client acquisition and discovery, RBI-regulated payment processing, customer support, dispute resolution mechanisms, and Managed Legal Team coordination.

3. Cancellation Policy

3.1 Consultation Cancellations by Clients

  • More than 24 Hours Before Scheduled Time: If a User cancels a scheduled consultation at least twenty-four (24) hours prior to the appointment time, a full refund (100%) of the consultation fee will be initiated to the original payment method.
  • Within 24 Hours of Scheduled Time: Cancellations made within twenty-four (24) hours of the scheduled time are subject to a nominal cancellation fee to compensate the Independent Professional for reserved time. The remaining balance will be refunded or credited to the User’s wallet.
  • No-Show Policy: If a User fails to attend a scheduled Online Chamber consultation without prior notice, no refund shall be processed.

3.2 Cancellations by Independent Professionals

In the rare event that an Independent Professional cancels a scheduled consultation or is unable to attend due to unforeseen court commitments or emergencies, the User will be notified immediately. The User shall be given the option to: (a) reschedule the consultation at no additional charge; or (b) receive an immediate 100% full refund to their original source of payment.

3.3 Subscription & Managed Legal Team Cancellations

Users subscribing to monthly or annual Startup/MSME packages or Lawyer Subscriptions may cancel their subscription at any time through their account dashboard or by contacting support. Cancellation prevents auto-renewal for the subsequent billing cycle. Services will remain active until the end of the current prepaid billing period.

4. Refund Policy and Statutory Rights

4.1 General Refund Framework

Subscription fees, one-time lawyer registration onboarding fees, and completed consultation charges are generally non-refundable once the service or billing period has commenced, except under the specific circumstances detailed below:

  • Service Cancellation by Company: If Court-Kachahri materially alters, suspends, or cancels a subscribed service or program without cause, a pro-rata refund for the unexpired period will be issued.
  • Statutory Consumer Rights: Where mandatory provisions of the Consumer Protection Act, 2019 or E-Commerce Rules entitle the User to a refund or withdrawal.
  • Technical Failures / Double Deduction: In case of duplicate transactions, payment gateway errors, or server time-outs where payment was debited but service was not activated, a full 100% refund is initiated automatically upon verification.
  • Non-Delivery of Non-Litigation Milestones: For milestone-based non-litigation services (e.g., trademark drafting, incorporation documentation), if an engaged Independent Professional fails to initiate work within the stipulated timeline and the User requests cancellation prior to work commencement, a full refund minus payment gateway transaction charges will be processed.

4.2 Government and Statutory Fees Exclusion

STATUTORY FEES NON-REFUNDABLE: Government fees, stamp duty, ROC/MCA filing fees, trademark registry fees, GST registration government charges, and notarization fees paid to statutory authorities or third parties in connection with non-litigation services are strictly non-refundable under any circumstances once deposited with the respective government authority.

5. Payment Processing and Security via RBI Gateways

5.1 RBI-Regulated Gateways

All online payments across Court-Kachahri are processed exclusively through Reserve Bank of India (RBI)-authorized payment aggregators and gateways (including Razorpay and Instamojo). The Company does not directly capture, store, or process complete credit card numbers, debit card details, or banking PINs on its servers.

5.2 Enterprise Security Standards

All financial transactions are secured using industry-standard TLS 1.3+ encryption and comply with PCI-DSS (Payment Card Industry Data Security Standard) guidelines and applicable RBI directives regarding digital payment security and two-factor authentication (2FA).

6. Refund Processing Timelines and Settlement

Once a refund request is approved by the Court-Kachahri Grievance and Support team, the processing timelines are as follows:

  • Credit / Debit Cards & Net Banking: 5 to 7 business days for the credit to reflect in the User's bank account, depending on the issuing bank's processing cycles.
  • UPI / Wallets: 24 to 48 hours for the credit to reflect in the linked UPI account or wallet.
  • Platform Wallet / Credits: Immediate (within 2 hours) credit to the User's Court-Kachahri account for future use.

If a refund does not reflect within ten (10) business days, Users are requested to contact our billing team with their transaction ID and bank reference number.

7. Anti-Circumvention and Payment Integrity

To maintain marketplace integrity and protect client security, all financial engagements between Users and Independent Professionals introduced through Court-Kachahri must be processed through the Platform. Direct contracting, off-platform billing, undisclosed cash payments, or soliciting clients outside the Platform constitutes a material breach of the Terms and Conditions.

In case of circumvention or fraudulent billing, CGS AI Tech LLP reserves the right to terminate account access immediately, forfeit pending revenue-share payouts, and initiate legal proceedings under applicable contract and cyber laws.
