Terms and Conditions

Preamble & Critical Notice

THESE TERMS AND CONDITIONS (“Terms”) constitute a legally binding agreement between the User and CGS AI Tech LLP, a Limited Liability Partnership duly incorporated and registered under the Limited Liability Partnership Act, 2008, bearing LLPIN ACY-3562, operating under the brand name Court-Kachahri (“Company,” “we,” “our,” or “us”), accessible at www.court-kachahri.com and through associated mobile applications and software interfaces (collectively, the “Platform”).

Court-Kachahri is a technology-driven platform that provides: (a) Online Legal Chambers for advocates and legal professionals; (b) AI-assisted legal research, drafting, and document tools; (c) a lawyer and professional discovery marketplace; (d) Managed Legal Team coordination services for MSMEs, startups, and organizations; and (e) a legal education and community ecosystem for law students and professionals.

CRITICAL NOTICE: Court-Kachahri operates exclusively as a technology intermediary and managed coordination platform. The Company does not provide legal advice, legal representation, or professional services of any nature. For Managed Legal Team services, the Company coordinates independent advocates, law firms, and qualified professionals who independently deliver all legal and non-litigation services. The Company itself provides no legal service, opinion, or professional guidance whatsoever.

By accessing or using the Platform in any manner, you unconditionally agree to be bound by these Terms, the Privacy Policy, the Disclaimer, the Community Guidelines, and all other applicable Platform policies. IF YOU DO NOT AGREE, YOU MUST IMMEDIATELY DISCONTINUE ALL USE OF THE PLATFORM.

1. Definitions

Unless the context otherwise requires, the following terms shall have the meanings assigned to them below:

  • “Advocate” means a person duly enrolled with a State Bar Council under the Advocates Act, 1961, who has registered a professional profile on the Platform.
  • “AI Legal Assistant” means the large language model (LLM)-powered tool provided on the Platform for legal research, document analysis, drafting assistance, and legal information retrieval.
  • “Client Organisation” means any MSME, startup, company, LLP, partnership, or other legal entity that engages the Platform for Managed Legal Team Coordination Services.
  • “Content” means any information, text, documents, images, data, profiles, posts, or material uploaded, submitted, published, or transmitted through the Platform.
  • “Court-Kachahri Platform Fee” means the thirty percent (30%) platform coordination fee applicable to all professional service transactions conducted through the Platform.
  • “Digital Personal Data” has the meaning assigned under the Digital Personal Data Protection Act, 2023.
  • “Independent Professional” means any advocate, law firm, chartered accountant, company secretary, trademark professional, compliance consultant, or other licensed service provider registered on the Platform, who operates as an independent contractor and not as an employee, agent, or representative of the Company.
  • “Managed Legal Team” means a coordinated arrangement through which the Company connects a Client Organisation with one or more Independent Professionals who collectively provide legal, compliance, or non-litigation services to that Client Organisation under independent professional engagements.
  • “MSME” means a Micro, Small, or Medium Enterprise as classified under the Micro, Small and Medium Enterprises Development Act, 2006.
  • “Online Chamber” means the virtual workspace and consultation infrastructure provided by the Platform for use by registered advocates and legal professionals.
  • “Platform” means www.court-kachahri.com, associated mobile applications, software, APIs, and all related technology infrastructure operated by CGS AI Tech LLP.
  • “Professional Revenue Share” means the seventy percent (70%) of service fees payable to Independent Professionals for services rendered through the Platform.
  • “Subscription” means a paid plan purchased by a User for access to premium Platform features on a recurring or fixed-term basis.
  • “User” means any natural person or legal entity that accesses or uses the Platform in any capacity.

2. Acceptance of Terms

2.1 Binding Agreement

By accessing, browsing, registering on, or using the Platform in any manner, you confirm that: (a) you have read and understood these Terms in their entirety; (b) you have the legal capacity to enter into binding contracts; (c) you agree to be bound by these Terms, the Privacy Policy, the Disclaimer, and all incorporated policies; and (d) these Terms are fair and reasonable in the context of a technology intermediary operating in the legal services sector.

2.2 Platform Access Agreement

By selecting “I Agree & Continue” at any point on the Platform, each User confirms and acknowledges that:

  • Court-Kachahri is a technology platform and not a law firm, court, judicial authority, government authority, legal aid authority, educational institution, placement agency, or regulatory body;
  • The Platform acts solely as a technology intermediary and coordination facilitator;
  • All professional relationships established through the Platform exist exclusively between the concerned User and the concerned Independent Professional;
  • The Company does not guarantee legal outcomes, regulatory approvals, court decisions, business success, employment opportunities, internship selection, or any professional outcome;
  • AI-powered tools are provided for informational and assistance purposes only and do not constitute legal advice of any nature;
  • Users are solely responsible for information submitted, documents uploaded, content published, and decisions taken through the Platform.

2.3 Consequences of Non-Acceptance

If you do not agree to any provision of these Terms, you must immediately discontinue all access to and use of the Platform. Continued use after notification of any amendment constitutes acceptance of the amended Terms.

3. About Court-Kachahri and Platform Services

3.1 Platform Overview

Court-Kachahri is an integrated legal technology platform designed to democratize access to legal services across India through artificial intelligence, location-based professional matching, online legal chambers, and coordinated legal team management. The Platform serves startups, MSMEs, individual litigants, law students, and legal professionals across all tiers of Indian cities.

3.2 Core Services Table

3.3 Technology Intermediary and Coordination Role

Court-Kachahri operates as: (a) a technology intermediary within the meaning of Section 2(1)(w) of the Information Technology Act, 2000; and (b) a managed coordination platform that connects Client Organisations with Independent Professionals. The Company’s role is strictly limited to providing technological infrastructure, coordination architecture, professional matching, payment facilitation, and platform management. The Company does not at any point deliver, supervise, control, or bear professional responsibility for any legal advice, legal representation, compliance guidance, or professional service rendered by any Independent Professional or law firm through the Platform.

4. Not a Law Firm — Fundamental Disclaimer

4.1 No Legal Practice

Court-Kachahri is not a law firm, legal practice, legal aid authority, solicitor’s firm, bar association, government authority, court, judicial institution, or statutory body of any nature. The Company does not hold a licence to practice law and is not enrolled with the Bar Council of India or any State Bar Council.

4.2 Services Not Provided by the Company

The Company does not, under any circumstances, directly or indirectly provide:

  • Legal advice, legal opinions, or professional legal guidance of any kind;
  • Legal representation before any court, tribunal, arbitral body, or regulatory authority;
  • Advocacy, pleading, or court appearance services;
  • Professional certifications, official legal endorsements, or regulatory clearances;
  • Compliance advice, tax advice, or professional opinions in its own capacity;
  • Non-litigation services including company registration, trademark filing, or GST registration in its own name or capacity.

4.3 Managed Legal Team — Coordination Only

For Managed Legal Team services, the Company coordinates and manages the engagement of Independent Professionals and law firms on behalf of Client Organisations. In this role:

  • The Company acts exclusively as a coordinator and technology intermediary;
  • All legal advice, compliance guidance, documentation, filings, and professional services are rendered solely and independently by the engaged Independent Professionals or law firms;
  • The professional-client relationship for all such services exists exclusively between the Client Organisation and the concerned Independent Professional or law firm;
  • The Company bears no professional responsibility, liability, or accountability for the quality, accuracy, legality, or outcome of any service rendered by an Independent Professional;
  • The Company does not supervise, review, approve, endorse, or guarantee any professional advice, opinion, filing, or representation made by any Independent Professional.

4.4 No Attorney-Client Relationship with Court-Kachahri

No attorney-client relationship, professional relationship, fiduciary relationship, or relationship of trust or confidence is created between any User and CGS AI Tech LLP or Court-Kachahri by virtue of: using the Platform; engaging with AI tools; uploading documents; requesting services; or entering into a Managed Legal Team arrangement. Any such relationship, if created, exists exclusively between the User and the concerned Independent Professional.

5. Eligibility and Capacity

5.1 General Users

Access to the Platform is restricted to persons who: are at least eighteen (18) years of age or the age of majority in their jurisdiction; possess legal capacity to enter into binding contracts under the Indian Contract Act, 1872; are not disqualified from contracting under applicable law; and provide accurate, current, and complete registration information.

5.2 Organizational Users

Companies, LLPs, partnerships, and other legal entities may access the Platform through authorised representatives who warrant that they have the authority to bind the organization to these Terms.

5.3 Minors

Persons below eighteen (18) years of age are not eligible to register or use the Platform. Any registration by a minor shall be void ab initio. Parents or guardians who become aware of unauthorized registration by a minor must notify the Company immediately for account deletion.

5.4 Refusal of Registration

The Company reserves the right, at its sole discretion, to refuse registration, restrict access, or terminate accounts without providing reasons, particularly where eligibility criteria are not satisfied or there is a risk of misuse.

6. Account Registration and Security

6.1 Registration Obligations

All Users must: provide accurate, true, and complete information at registration; maintain the accuracy and currency of all account information; maintain strict confidentiality of login credentials and authentication tokens; not share access credentials with any third party; and immediately notify the Company of any unauthorized account access or suspected security breach.

6.2 Account Security & One Account Per User

The Company implements multi-factor authentication and enterprise-grade security. However, Users bear primary responsibility for the security of their credentials. Each natural person and each legal entity may maintain only one active account. Creation of duplicate accounts or accounts with false identities is prohibited and may result in immediate termination of all associated accounts.

7. Advocate Registration and Professional Declaration

7.1 Advocate Declaration

Every advocate registering on the Platform hereby declares, warrants, and undertakes on a continuing basis that:

  • They are a duly enrolled advocate possessing valid authorisation to practice law in India under the Advocates Act, 1961;
  • All information, documents, enrollment details, qualifications, professional experience, and representations submitted are true, complete, and accurate;
  • They will immediately update any information that becomes inaccurate, expired, suspended, or revoked;
  • They understand that Court-Kachahri is a technology platform only and is not their employer, partner, principal, agent, or professional supervisor;
  • They act as an independent professional and not as an employee, agent, representative, or partner of CGS AI Tech LLP;
  • They shall comply with the Advocates Act, 1961; Bar Council of India Rules; applicable court directions; professional ethics and conduct rules; and all applicable laws;
  • Any advocate-client relationship established through the Platform exists solely between them and the concerned client;
  • Court-Kachahri does not supervise, control, or direct their professional judgment and does not guarantee any engagement, income, or client relationship;
  • They shall maintain strict confidentiality of all client information and communications, and such obligations continue after cessation of Platform association.

7.2 Advocate Prohibitions & Indemnity

Advocates shall not misrepresent qualifications, provide false information, engage in fraud or forgery, violate professional ethics or Bar Council of India Rules, misuse client information, or circumvent the Platform for clients acquired through Court-Kachahri. Each Advocate agrees to be solely liable for their professional conduct, advice, services, negligence, errors, omissions, misconduct, and violations of law, and to indemnify and hold harmless CGS AI Tech LLP from any claims arising therefrom.

8. Professional Registration — Non-Advocate Service Providers

Every non-advocate professional (Chartered Accountants, Company Secretaries, Tax Professionals, Trademark Professionals, Compliance Consultants, and other licensed experts) registering on the Platform declares that they are legally qualified, authorised, and competent to provide the services for which they register under ICAI, ICSI, ICMAI, or other respective governing bodies. They operate solely as independent professionals and agree to indemnify CGS AI Tech LLP against any claims arising from their professional services or misconduct.

9. Managed Legal Team Coordination Services

The Managed Legal Team Coordination Service enables MSMEs, startups, and organizations to access coordinated legal and compliance support through the Platform. The Company’s role in this service is strictly limited to: identifying, matching, and coordinating Independent Professionals and law firms; providing technology infrastructure; managing scheduling, documentation, and payment processing; and maintaining quality assurance frameworks at the platform level.

All legal advice, compliance guidance, documentation, statutory filings, representations, court appearances, and professional services within a Managed Legal Team arrangement are rendered exclusively and independently by the engaged Independent Professionals and law firms. The Company does not at any stage deliver, participate in, supervise, approve, review, or bear professional responsibility for any such service.

10. Online Chambers — Terms of Use

Online Chambers provide virtual workspace infrastructure for registered advocates and legal professionals. The Company provides technological environment only and bears no responsibility for professional conduct, advice, or services delivered within the chamber. Advocates using Online Chambers shall conduct all consultations in accordance with the Advocates Act, 1961 and Bar Council Rules, maintain attorney-client privilege, and not record consultation sessions without express consent of all parties.

11. Artificial Intelligence Services

The AI Legal Assistant and AI-powered tools are LLM-based systems provided for legal research, legal information retrieval, document drafting assistance, compliance guidance, and educational purposes. These are informational aids only and do not constitute a legal professional, licensed advisor, or source of legal advice.

AI LIMITATIONS ACKNOWLEDGEMENT: Users expressly acknowledge that AI-generated outputs may contain errors, inaccuracies, hallucinations, omissions, or outdated information. AI outputs shall not be filed before any court, tribunal, government authority, or regulatory body without independent professional review and certification by a qualified legal practitioner.

12. Acceptable Use and User Conduct

All Users shall use the Platform lawfully and ethically. Users shall not violate any applicable law; provide false or misleading information; upload fraudulent documents; misrepresent qualifications; impersonate any person; harass or abuse other users; distribute malware; circumvent security measures; engage in unauthorized data scraping; or circumvent the Platform to directly engage clients acquired through Court-Kachahri.

Prohibited content includes content violating the IT Act, 2000 or IT (Intermediary Guidelines) Rules, 2021; obscene content under Section 67 of IT Act; hate speech under Bharatiya Nyaya Sanhita, 2023; fabricated court orders; or content constituting contempt of court under the Contempt of Courts Act, 1971.

13. Community Guidelines and Standards

The Court-Kachahri community platform is designed for professional legal discourse and knowledge sharing. All participants shall maintain professional dignity, factual accuracy, and collegial respect. Court-Kachahri reserves the right to monitor, review, remove, or restrict any community content at any time, with or without notice, that it determines violates these Terms or applicable law.

14. Professional Fees, Revenue Sharing, and Payout Policy

14.1 Revenue-Sharing Framework (70:30 Model)

For every paid service, consultation, assignment, project, or engagement obtained through Court-Kachahri, a transparent revenue-sharing model applies: Independent Professional / Law Firm receives 70% of service value; Court-Kachahri Platform Coordination Fee constitutes 30% of service value.

14.2 What the Platform Fee Supports

The 30% Court-Kachahri Platform Fee covers: technology infrastructure and platform development; professional verification and credential management; client acquisition, discovery, and matching services; payment processing and settlement infrastructure; customer support and dispute management; platform security and compliance monitoring; community operations; and Managed Legal Team coordination.

14.4 Client Protection and Platform Integrity (Anti-Circumvention)

All Professionals shall not circumvent the Platform by directly soliciting, contracting, or billing clients introduced through Court-Kachahri outside the Platform; collect undisclosed or additional payments from Platform clients outside the agreed fee; misrepresent service scope or fees; or engage in overbilling. Violation constitutes a material breach resulting in immediate termination of Platform access and forfeiture of pending payouts.

15.2 Refund Policy & Payment Security

Subscription fees are non-refundable except where the Company cancels or materially alters a subscribed service, a statutory right applies, or agreed in writing. All transactions are processed through RBI-authorized payment gateways (Razorpay, Instamojo). Financial data is protected pursuant to PCI-DSS standards and applicable RBI guidelines.

16. User Content, Documents, and Intellectual Property

Users are solely responsible for all Content uploaded or published and warrant they possess necessary rights and permissions. By uploading Content, Users grant CGS AI Tech LLP a limited, non-exclusive, royalty-free licence to store, process, display, and transmit the Content solely to provide Platform services. All intellectual property in the Platform (software, algorithms, AI models, design, logos, branding) is owned by CGS AI Tech LLP.

17. Data Practices, Digital Records, and Privacy

The Company processes personal data as a Data Fiduciary under the Digital Personal Data Protection Act, 2023. All records generated, stored, processed, or transmitted through the Platform constitute electronic records under the Information Technology Act, 2000 and are subject to the provisions of the Bharatiya Sakshya Adhiniyam, 2023 regarding admissibility of electronic evidence. Company, startup, and client data uploaded shall be treated as strictly confidential.

18. Account Suspension, Restriction, and Termination

The Company may suspend, restrict, or terminate any account, with or without prior notice, for violation of these Terms, fraudulent or deceptive conduct, professional misconduct, valid court orders or bar council directions, non-payment, or circumvention of the Platform. Users may terminate their account at any time by submitting a written deletion request.

19. Disclaimer of Warranties

The Platform and all services are provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, the Company expressly disclaims all warranties including merchantability, fitness for purpose, non-infringement, accuracy of AI outputs, uninterrupted service, or competence/conduct of any Independent Professional.

20. Limitation of Liability

To the maximum extent permitted by law, CGS AI Tech LLP and its partners, officers, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive loss or damage; legal losses; adverse judgments; or loss arising from AI outputs or acts of Independent Professionals. In all events, the aggregate liability of CGS AI Tech LLP shall not exceed the total amount paid by that User to Court-Kachahri during the twelve (12) calendar months immediately preceding the claim.

21. Indemnification

Each User agrees to defend, indemnify, and hold harmless CGS AI Tech LLP, its designated partners, officers, employees, and affiliates from against any claims, proceedings, damages, liabilities, penalties, fines, costs, and expenses (including legal fees) arising from any breach of these Terms, violation of applicable law, User Content, misrepresentation of identity/authority, misuse of AI outputs, unauthorized recording within Online Chambers, or circumvention of the Platform.

22. Force Majeure

The Company shall not be liable for failure or delay in performance arising from causes beyond its reasonable control, including Acts of God, natural disasters, pandemics, war, terrorism, governmental actions, internet infrastructure failures, power outages, cyberattacks, DDoS attacks, or data centre failures.

24. Governing Law and Dispute Resolution

24.1 Governing Law & Amicable Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Prior to formal dispute resolution, parties shall make genuine good-faith efforts to resolve any dispute amicably within thirty (30) calendar days of written notice.

24.2 Arbitration & Exclusive Jurisdiction

Failing amicable resolution, all disputes shall be finally resolved by binding arbitration under the Arbitration and Conciliation Act, 1996 (as amended). The seat and venue of arbitration shall be New Delhi, India. The arbitration shall be conducted by a sole arbitrator mutually appointed. Courts of competent jurisdiction at Delhi, India shall have exclusive jurisdiction over matters not subject to arbitration.

25. Grievance Redressal Mechanism

Pursuant to Rule 3(2) of the IT (Intermediary Guidelines) Rules, 2021, the Company has appointed a Grievance Officer who shall acknowledge grievances within twenty-four (24) hours and resolve them within fifteen (15) calendar days.

Users dissatisfied with the Grievance Officer’s resolution may escalate to the Data Protection Board under the DPDP Act, 2023, the appropriate consumer forum under the Consumer Protection Act, 2019, or initiate arbitration.

26. Miscellaneous Provisions

These Terms, together with the Privacy Policy, Disclaimer, Community Guidelines, and any applicable Subscription Agreement, constitute the entire agreement between the User and CGS AI Tech LLP. No failure or delay in exercising any right constitutes a waiver. If any provision is found unenforceable, it shall be severed and remaining provisions shall continue in full force. Nothing in these Terms creates a partnership, joint venture, agency, franchise, or employment relationship. These Terms are in the English language, which prevails over any translation.
